Hi I was wrongly shipped the xbox version of SCCT instead of the PC one. I heard that by US law I am entitled to keep this and they MUST send me my pc version as long as I supply them with my proof of order.

Could someone please link me or tell me where this law is located so when I go on the phone with gamestop customer support I don't sound like an idiot when they ask me which law says I don't have to return it. Thanks

if your bill of sale is correct then they should replace it for no charge to you since it was in thier error.

You do not get to keep both as that at would be paying for only one of them.

you return the wrong one they excange it for the right one
 
Ok this is great. I waited 4 days for this POS to get here and now I gotta wait even more?

Even if it is legal to keep the other copy which i highly doubt, they would take 6 months to get you the PC version copy cos you're trying to screw them out of money. Just send it back, then ring them to confirm they got it and they have dispatched a new copy. These things always happen, those companies are generally incompetent.

Er...no. If a vendor sends you the wrong goods by mistake, you must either send them back at the vendors expense or make arrangements for them to be picked up. You cannot keep goods mistakenly sent to you and then request that the correct goods be sent as well. That would be 'unjust enrichment'

Even if you could - that would be morally wrong.

Good luck finding any laws anywhere on the internet except for rants on the Second Amendment. US law is not something that is easy to look up.
 
Noooo. They must replace it for free, but you can't keep the wrong copy. It wouldn't make any senses. It would be like each time you receive something that has a default or isn't what you asked for, you get a double of this thing. Just imagine what it would be with cars :P
 
You can either keep the copy you have now, but get nothing else, or send it back and get the correct one. Or if the company's individual policies allow it, send back and be refunded.
 
Ok I sent it back through fedex...gamestop will pay all the shipping to get the box and to send me the PC replacement with 2 day shipping. Now I got to wait until NEXT WEEK to get my game. *sigh* looks like I'm never gonna play this game.

/me goes to play the demo, for the 19th time...

What does SCCT stand for by the way? Apparantly it sounds fun? :P
 
I felt the same way when I preordered Halo 2, it came a week late. :angry: :(
 
If you're reasonably confident that there has not been a legitimate mistake about the order, we can treat any unordered merchandise we receive as a gift. It's illegal for a seller to send us bills or dunning notices for merchandise we didn't order or ask us to send back the merchandise — even if the seller offers to pay the shipping costs. What's more, if the seller sends us items that are different from our order in brand, type, quantity, size, or quality — and hasn't gotten our approval first — we may treat the substitutions as unordered merchandise. We can treat unordered services the same way. But always consider the possibility that the seller has made an honest mistake

Very different thing to keep goods that are not yours because of a mistake, then it is to be billed for things that are not ordered. I think your case falls into the 'legitimate' mistake category. Not where people are charging you for services you have not ordered through forced sales.
 
Also it would kind of be an assholish thing to do anyway. I mean, it was an honest mistake, wouldn't be right to cheat them.

Also, what's that game about too? I'm curious of it.
