What if ESRB, while checking game content, did a five minute check of TOS and EULA to see if a game has any sort of spyware/behaviour tracking programs embedded in it.

Then, they just put at the bottom of the big M on the game box...

"Game may contain Spyware"

HMM?

EDIT: I don't have a problem with non-malicious software probing through what ingame ads I look at, or occasionally peeping what sites I go on, but FFS tell me BEFORE I buy the game.
 
It would be great, but nobody but us smart gamers would utilize it, and we'd still buy cool games irregardless.

I don't buy spyware. :p
I hope we don't have to resort to that but it would be a good idea if too many games follow this trend.
