You're legally required to pay if you win an auction on eBay, if you don't you can get sued, iirc there IS no excuse for winning an auction and refusing to pay, so if he doesn't, he'll be recieving a large hefty "fine".

U hear about the guys that baught an Xbox 360 box, that cracked me up, it went for £250 + if i remember right, how dissapointed he must have been when he got his box, owned.

Actually it was a PS2 box and the auction title went something along the lines of

'PS2 box(ed missing obviously) in time for Christmas!!'

No this was definately an Xbox360 it was rather recently, maybe it was the same guy, or a person who copied it from the PS2 box trick

Not unless you and the auctioneer come to an agreement to not buy the item. Happened to me once before.
