Judge throws out Pvt.England's guilty plea

Allen Rudy, a Dallas attorney, said Wednesday he could not recall a military plea being scrapped under such circumstances during his 25 years as a Navy lawyer and judge.

I read that twice, but I don't get it.

She admitted to the crime, but the judge is throwing the plea out based on the flimsy testimony of the guy who has already been convicted and who might be her baby's father? And based on that testimony, the judge believes that she had absolutely no clue that she was doing the wrong thing by torturing people?

Yeah, like the boyfriend and co-conspirator is going to be a reliable source of info. :rolleyes:

I'm reminded of the mad magazine cartoon where the obvious killer is let go, but the judge is sentenced to life in prison for being an idiot.

it can be interpreted one of 2 ways (IMHO)

1. she's getting off on a technicality
2. they wanted bigger fish to fry: if she didnt know it was illegal than that means that someone directed her to abuse those prisoners

I doubt she knew what she was doing. I'm sure international and military law become confused in times of war... hopefully everybody gets their cummupins though.

but surely any sane person knew what they were doing was wrong.

Yeah well when you are in the military you dont pick what orders you choose to follow and which you disobey. Maybe stern would, even if his whole batallion died as a result of it :E

oh and I wouldnt be on a battlefield cuz I've seen the "intelligence" that led to this war ...even before it started ..it's all here ...isnt the freedom of information act a marvelous thing?
