"In 2005, 15-year-old Ashley was facing trial in Manhattan Family Court for lying to police after she told officers she didn't know who had assaulted her on the way to school.

As she waited in the court's holding area for her court appearance, juvenile counselor Tony "Tyson" Simmons came up to the handcuffed girl, took her in an elevator to the building's basement, and raped her.

Moments later, Ashley -- who's withholding her last name for fear of reprisal -- was in the courtroom being sentenced to 12 months in prison for filing a false police report. This week, Simmons was sentenced to 10 years' probation for the sexual assault on Ashley and two other teens."

wow, I hope that guy gets life in jail and 2 big guys to rape him every damn night

Im confus.

I don't think lying about rape deserves getting raped. I know it's pretty sick, and I can't believe I'm saying this as a guy after she tried to get a guy done, but she probably didn't deserve it.

On the other hand, Karma, she got hers etc.

for all you know she could have been afriad to give the names of her assailants. this isnt karma it's an abuse of power by an authority figure who's supposed to be helping her. 10 years probation is a freakin joke

For all you know, she could have been ruining some dude's entire life just out of spite.

She got found guilty right?

I agree it's not Karma, I shouldn't have written that, but people that cry rape make it difficult for women who actually have been raped to get justice. If she did lie, she deserved at least a savage beating.

And yes, the court guy is a scumbag, now he DOES deserve to get raped.

you know at least you could pretend that you read the article. she was charged with falsifying a police report because she didnt identify her assailants: no suspect = no case. she's "guilty" of not providing the names of her assailant

you assumed that was the case. it's no better than assuming she "had it coming"

I read the article, it gives little more information that was in your op?

So they imprisoned her for 12 months because she simply didn't know the name of the assailant? I bet 99% of rape victims don't know the identity of their assailants.

You're right though, I am jumping to conclusions, but I can't believe that they imprison 99% of rape victims.

Twelve ****ing months in prison for refusing to say who assualted her?!

I'd put money on her being black, it must be racism.

She's a ****ing child. Seriously, what the **** is this shit America.

How does a 15 year old (at the time of the supposed crime) get sentenced to a year in jail? I mean, its completely bullshit that she gets charged with lying to police for not giving them a name, but the fact that she gets jailed for a year as a minor is completely unfathomable. Then the fact that rape isn't punished nearly as bad as not saying/knowing who raped you the first time makes me want to leave this planet. Thats as ass backwards as Sharia Law.

Seriously, 10 months of probation for rape, 12 months of jail for getting raped and not saying who did it... WHAT THE ****

EDIT: MULTIPLE RAPES. 10 months probation for pleading guilty to THREE RAPES of UNDERAGED GIRLS.

I don't want to live on this planet anymore.

EDIT2: Oh, years. Not like that makes a ****ing lick of difference.

10 years probation ..still a slap on the wrist

Girl who cried rape. Seriously, how does it take 5 years.

This is infuriating, pissed for the rest of the day.

This is absolutely disgusting, I don't care what she's convicted for, she's a little girl. 15 isn't old at all. The guy pleaded guilty to 3 rapes on a minor, that's pedophilia, and rape... Life in jail at least? Please? The girl should be talked to about how the police can protect her, and that should be the MOST of her punishment, if she even could be punished for this... This is pure perversion.

Thats messed up. I dont even understand how they came to a logical conclusion that either of those sentences made sense.

I pretty much echo the WTFs in this ****ing thread - but does anyone else think that he tried to get away with it? He thought she wouldn't tell, or they wouldn't believe her (she cried wolf).

Wow... that's some serious predator mentality right there.

I mean shit... makes me wonder how many people out there would be like that. Doing evil stuff simply because they think they can get away with it because an opportunity presents itself.

I mean... wow. It's disturbing to think what was probably going through his head. "This girl is being tried/charge whatever for lying to police officers about a sexual assault case. Hmm... nobody around, I could rape her and get away with it because she lacks credibility."

Terrible shit.

Like I said, it makes me wonder how many normally ordinary people might be capable of this.

Are you dense or something?

How can you so badly misunderstand what was printed in the article.

I bet 99% of rape victims don't know the identity of their assailants.

Quite the opposite, actually. Most rapes are carried out by people who know the victim very well. Boyfriends, friends, family members etc...

These are the sorts of stories that make me want to build myself a self-sufficient compound out in the wilderness somewhere where I'd never have to interact with humankind again. How utterly soulless would you have to be?

-headshake of wordless anger-

Yeah well shit happens.

This is why you all should make me Supreme Dictator of all Mankind. Both would be executed, all of you would be happy, especially since you wouldn't even know it happened.

) How in the world does not revealing the name of an attacker indicate 'falsifying a police report'.

) Police gave her 12 months for not revealing the name of someone. That's a totally unrealistic punishment for that

) Adolescents do not "go to prison". They go to Juvenile detention.

) They wouldn't send her to juvenile detention for a year for one stupid mistake. Jesus, do you know the shit I did when I was a child?

You know whats even worse about this story? She actually served nearly three years instead of the one.

While pondering Simmons' probation for the courthouse rape the day she got 12 months, Ashley notes that she actually served nearly three years.

She is not of the streets and that made her the target of kids who were. And, as the shock of the rape turned to anger, she often talked back to counselors.

"You say something, they throw you on the floor; 60 days, 90 days, 120 days added to your sentence," she said.

"If she didn't want to be victimized, she shouldn't have worn handcuffs. She was practically asking for it."

no suspect = no crime. case falls apart due to actions of victem, resources wasted, court tries to send message to people not to waste court's time
