I have just had a summons to appear in court for having my car on the road when it was declared SORN.

Looking for some advice for any of the legal folks here or anyone who has had any experience with this sort of thing.
My brother bought a car last year,and as he hadnt passed his test yet,declared it off road.He had no intention of driving the car till he passed his test,but as he lives in a flat he has no drive or garage to keep the car in.The intention was to keep it in a mates garage but that was delayed as room had to be made before my brothers car would fit.
Just before Christmas my brother received a letter from the DVLA saying the car had been seen parked in his street and as he had declared it off road he was liable for a fine of £140 which he promptly paid and then got his mate to sort his garage out so he could get the car off road asap.
He thought that was the end of it and although he was 140 quid down accepted it was his fault for not sorting it out sooner,but today he recieved a court summons stating that his car has been had been seen parked in the street on the 1/12/05(this is a couple of weeks after the original"sighting",but obviously as he hadn't received the first letter at that time,was unaware of any escalating problem) and as it had been declared off road,he would be required to attend court,blah ,blah.
So he basically received a letter/fine just before Christmas,stating the car had been seen on 10th November(may not be exact date),then,after immediatley paying the fine and getting the car off road,3 weeks later he recieved the summons.Is this normal?Surely the fact that he paid the fine would have dealt with the matter
Any advice would be appreciated.My brother is mighty peed off,the car has cost him a fortune,now a summons and he still hasnt passed his test,lol,he hasnt even driven it yet.
