SAN FRANCISCO, California (Reuters) -- A Montana mother who allowed her 18-month-old baby daughter to inhale from a marijuana water pipe was properly convicted, but should not have to spend five years in jail, a U.S. appeals court ruled Friday.

Jessica Durham was photographed allowing her toddler Michala to suck from a marijuana water pipe, also known as a bong, in 2004 by a friend upset about the activity.

"Ms. Durham allegedly remarked that smoking improved Michala's appetite and left Michala lethargic and mellow - a manner she found consistent with her own experience smoking marijuana," Judge Louis Pollak of the U.S. 9th Circuit Court of Appeals wrote in summarizing the case.

In 2005, a lower court sentenced Durham to five years in prison for unlawful marijuana distribution. She appealed both the conviction and the sentence.

In its ruling Friday, a three-judge panel of the 9th Circuit upheld the conviction but said the sentence exceeded the applicable federal law which calls for punishment of no more than two years in prison.

I highly doubt the baby will have died from a few vaporized bong hits. Though, he'd probably would have been a lifelong burnout.

No no, I meant if she had given the baby a lot more.
 
I still don't think she could've given the baby enough to kill him, it takes about 42 pounds(give or take) of MJ smoked a once to kill a normal adult and im guessing it would take a proportionally equal amount to have the same effect on a baby.
 
San Francisco, well that figures. That place is full of idiots, law-breakers and just bad people in general.

But making your infant smoke pot...

For America, she probably won't get much because drug laws don't seem to be taken seriously in the case of marijuana. In my opinion though, there should be laws about being stupid, especially with your own children, and she should be jailed and have her kid relocated to a better family.

I'm hardly a doctor ... but it doesn't sound that bad. I imagine it calms the baby down and keeps it from crying. Kind of like giving a baby a little rum to soothe its toothing. If I had a kid I would never give it to em', but I'm just saying it probably wouldn't hurt, might even help.

Unless of course she gave it a lot, then that's just stupid. Those are the developmental years and anything that stunts brain activity could have a long term effect on the kid.

Except it was bong SMOKE.

I might agree with you a TINY bit in the least if she used a vaporizer, but she didn't. Smoke is still extremely harmful to the lungs and especially to a baby with tiny developing lungs. That's where she could have died. Also dosage fit for adults inhaled by this baby is overboard.
