question reguarding the law!

ok
someone told me this and i cant see how it is possible.

driver is sober and gets pulled over.
cop tells the driver and the passengers to get out and walk the line and such.
now the driver is fine of course but (my friend said) that the passengers would have to walk teh line and end up going to jail or somthing..
lets say the passengers have nothing else to worry about law wise ie warrents this makes no sense to me
 
no, there is no law that prevents passengers from being drunk
 
yeah thats what i thought.. so my dad is being retarded..

now if everyone was drunk.. could the passengers go to jail?
 
are they under age? spitting at the cops? throwing up out the window? no? well then they're ok

Public intoxication. If they can't find anything else, they can always pull that one out of their ass, even if you're sober.

Except being in your car isn't in public. If you were yelling out the window then maybe yes.
 
Was there any open beer cans in the car? If so, then they can't just "assume" you didn't drink some beer.
 
Just remember... you can't have ANY open alcohol in the vehicle, even if it's not the drivers. They could get in trouble for that.

And unless you guys are sucking face or something, I don't think they can consider you a bottle of alcohol.
