Thief DS crashing

wondering if anyone else is having this problem
thief DS randomly crashes, either to my desktop, or it freezes the comp completely
my hardware/software is all installed properly
and my comp is being cooled sufficiently
new 400w PS
could be an ATI conflict cause its designed for nvidia
specs:

xp home sp1
radeon 9800 pro
athlon 2200
768ddr
sb live 5.1
MSI mobo VIA cs

all drivers up to date

everyone else experiencing thief issues??
