True, it's better to test your system by actually playing your games. But some people like to use the 3dmark programs to compare their systems to others that have posted their scores.

The MouseLagThreshold in Invisible War is set too high by default. That's what makes the movement feel so laggy and "jerky". By changing it from 75 to 0 in the default.ini you can greatly improve the movement feeling. And yes, the reason why the settings dont save is because the "read-only"...

Sounds to me like your 9800XT is possibly defective. I say this because my first 9800 Pro was defective and it did the exact same thing your 9800XT does when benchmarking. If you have another working video card laying around i'd swap it out for the 9800XT and see if you still have the same...
