9800 pro problems?

current temp's on my new machine, 32C, 47C after some gaming.
anyway

sok im playing max payne 2, i have all settings all the way up in display settings and on max 2's display setting , upon installation it said my 3d card isnt set to AGP acceleration, and i checked dxdiag and it wont let me turn it to taht, and i do have an agp card
im not sure.
anyways playing the game
the walls flicker as i move around, shimmer/flicker w/e, everything is great except for a part where there is fire the fire smoke was blocky, and last of all the death animations of the game arent going all the way through.

Install drivers for your chipset and install the 3.6 or 3.7 ati drivers...

Right click on the ATI control panel. Click settings; ATI Display Settings; SmartGART tab. Make sure the AGP setting is all the way up.
In your BIOS, make sure you have AGP set to 8x/4x/2x/whatever... Post here and say you fixed it, or you didn't fix it. Read next solution.

Also, in SmartGART, if Fastwrite is enabled, try disabling it
