Burnt marijuana smell not proof of drug

OTTAWA (AFP) - A Saskatchewan appeal's court upheld a decision that the smell of burnt marijuana is not evidence of illegal drug possession since by definition the proof has gone up in smoke, it said Wednesday.

In the US the smell would be "probable cause" for a drug test, though I'm not sure if they can administer a drug test against your will.

There's no accurate drug test for weed without taking a blood sample. And that has all kinds of controversy around it.

Though reeking of weed should be considered probable cause for being searched...

Accurate beyond a reasonable doubt? Because that's what the courts demand.

Hot damn I already knew this was true in the UK.



Ive spoken to cops stoned out of my face before but if you don't posess any illegal substances you are fine.
You can be arrested if you are carrying over a certain amount of weed. Usually though you get it confiscated and a warning, it's the dealers that get caught who can get a few years behind bars.

What are the laws like in other countries?
