Copyright problem

I've got a bit of an issue with a designer claiming copyright on an image.

Basicaly he created an image out of two royality free images for a website logo. Since then he has left the club and is claiming that he has copyright on the image and wants it taken down (he left on bad terms)

The thing is, its a simple enough image and could easily be recreated, but then can we even do that?

Any ideas?

Most hiring contracts state that anything created by the employee while working for the company becomes property of the company. Basically, if it was work you paid him to do, it belongs to the company, not him. Of course, it would depend on the contract he signed when you hired him, if there was one.

If it's from royalty free images, then just use those 2 images and remake it yourself.

Well the website was created part time by one of the club members, and the image was given to him to use by the guy that's claiming copyright.

I know this isn't the best place to ask, but I don't subscribe to any "legal forums"

Ok, I think I've got the answer to my problem.

Basicaly, he owns copyright on the derivative - but yes, I can receate it.

Just like if Mark was take take a photo of Ben, then Mark would own copyright to the image. But then if I took a photo of Ben in the same pose and same place then I would own the copyright for my own image.

Simple enough when you think about it I suppose

Check the licence for the royalty free images. It may well exclude use such as this.
