A Perry chiropractor continues to practice his craft nearly five months after being convicted of assaulting a patient by masturbating on her.

In the latest case, a woman went to Perry police on Jan. 12, 2010, to report that Duffy masturbated onto her lower back while he was adjusting her spine that day. Investigators took swabs of her back, and a test showed the presence of his semen.

Police charged Duffy with misdemeanor assault. Court records show his lawyer contended the semen might have gotten on the woman's back because Duffy had masturbated privately and then failed to wash his hands.

Dallas County Attorney Wayne Reisetter said he had wanted to file a more serious sexual-assault charge, but after talking to the state attorney general's office, he determined that the specific facts would not support such a charge under Iowa law. The main issue, he said, was that Duffy did not touch the woman's genitals, and she did not touch his.

"We certainly argued that he should receive some jail time. The judge didn't see it that way," Reisetter said. He added that the chiropractor would not be listed on the state sex abuser registry because he was not convicted of sexual assault.

That's ****ing infuriating.

Reminds me of a recent story from Japan about this brothel that employed actual underage schoolgirls to strip down to their underwear in a fake bedroom while paying customers could observe from a one-way mirror. Authorities tried to shut it down but there was nothing actually illegal about it. But in the end, luckily, they were able to shut it down due to "violating health and safety regulations relating to the employment of minors".

And also the strip club in Rhode Island that was legally employing underaged girls (completely nude), and police could not find anything illegal about it.

How would she have known he had traces of semen on his hands that would then go on to her lower back, enabling her to then say he masturbated on her just to be a bitch? Unless of course he walked in with a substantial amount of jizz dripping from his hands which seems far less likely to be accidental.

I do not understand the logic of this court case. :/

I had heard about that. That was ridiculous, but I'm pretty sure that soon after that case the mayor had signed some kind of law preventing establishments from renewing their license if they employed minors, thus closing the loophole they were using.
