1. I don't think so. I think it's just like any other console emulator, the emulators are legal, the illegal roms are not.

2. Yes, but unless you have an insanely good computer the games will run like crap. I tried running Disgaea (an isometric-view turn-based rpg with just sprites for graphics) and it couldn't break 20fps on my mid-upper range comp.

It's only fully legal if you make them yourself. Which is pretty hard, so people just download them (if they have the actual game, it is legal).
 
It's not legal to download the PS2 BIOS though...
 
The best emulator is called PCSX2. The reason it runs like crap unless you have an insane computer is because the ps2 has a retardedly complicated cpu. It runs best on multi-core processors. To run games you will need an image for the game and correct versions of the ps2 bios, which are both illegal to distribute. Good luck finiding those and getting it to run good.
 
hmmm, I think this is too damn early, and might not work on even high end computers, but how about ps3, 360, and wii emu.s?
 
All this talk of loony high end PCs makes me happy I'm happy to stick with my Megadrive emulators!
