nVIDIA did not remove dx9 from the drivers on their graphics cards... They ADDED dx9 support for GeForce FX 5600 though...
I know because I have a GeForce FX 5200 (which supports dx9.0, and not too slow because I don't have many problems playing Joint Operations. Though it's not a very demanding game it can get REALLY laggy when there are 100+ people on a server yet my card pulls through with about 15+ fps in rough situations and with high detail.)
