CptStern said:lets examine roe vs wade. in that decision it was 7-2 in favor of upholding privacy rights ...meaning that 2 supreme court justices felt/thought/believed that a woman didnt have a right to end her pregnancy. All 9 justices heard the same testimony, read the same briefs ...how can you not argue personal beliefs didnt come into play here?
I guess I'm flip-flopping as much as you are. As I said, the real issue with you is not whether personal beliefs come into play. You have a problem with people who don't share your personal beliefs. It wouldn't trouble you one bit if all 9 Supreme Court justices were pro-choice, strident atheists who believe (that's right, it's a BELIEF) gay marriage is a right. However, if all 9 justices were pro-life, Fundamentalist Christians who don't believe gay marriage should be allowed, you'd be screaming all over the place about it. Not because their personal beliefs might inform their decisions, as would the liberal justices, but solely because the beliefs possibly informing the conservative justices differ from yours. But if, as you say, personal beliefs shouldn't play a part, then there should be nothing to worry about, right? Or are you saying that conservative judges can't be trusted to be impartial? That's exactly what you are saying. Only liberal judges can make fair and impartial decisions. Hypocrite.
