Does anyone know if its legal for me to ditribute a mod on CD-ROM as long as I only charge say a quid to cover the CD and case?

Does that mod even exist? Google says no.

No its not legal to charge for a mod.
 
You're not charging for the "mod" you're charging for the materials for the case etc.
 
Charging? What is "charging". As far as I'm concerned it's a mandatory donation.

that will never fly in court... if you're so concerned about mailing it, have people mail you a blank dvd and shipping money then you mail it back to them... even then...
 
The charge would only cover the case, cover and blank CD, NO additional charges will be made as regards Valves intelectual property.

And yes that MOD does exist I just havent finished or released it yet, another MOD Called 'A Tramps Life' featuring the Same Main character Jerry should be complete and released by 'Group 10 Games' within the next few months.
Unfortunately I am not at liberty to release specific details about the mod other than its a bit cartooney, a bit silly and in 3rd person ;)

Try to release it asap if it's ready, people are waiting for a great SP mod :)

And one question that rests on my mind: Are the space nazis going to have swastikas? :O

Not in the versions he sends to Germany, that's for sure. There that is a legal issue.
 
Simple. Give them the CD for free and then if they want to box charge them for it. Although you would have to remove all copywrited material from it (ie the Valve logo)
 
You see I have just finished another mod for a university project where I was told that legally I had to credit valve and display their logo and copyright information on the casing! :rolling:

The mod unfortunately wont be done for at least another month or two as im slowly working on it in my spare time, and no, although theese are Fascist Nazi Aliens the swastika does not feature in the mod.
 
I think it's ok as long as you can also download the mod for free from a site.
 
It's not ok. Even if profits only cover the cost of the materials, it's still profit from someone elses work. Not ok.

There is no profit, thats the point, they only charge for the cases and shipping costs.
 
If i spend a pound on a case and a cd and charge someone else a pound for the same and cd but the cd has my mod on, where am I making profit??
 
it doesnt matter..

You're asking valve to believe that you aren't making a profit which might even set a precedent for future mods that try to do this. Stop trying to rationalize what you're doing.


If you want a hard no, then call/email valve and ask them yourself.
 
I dont really want to stir up anything, I just wanted anyone with actual experiance or knowledge to post a concise and straight forward answer so I dont get raped for giving my mod away.

As for valve believing im not making a profit, a blank CD, a DVD case and a colour laser printed cover for one english pound? if anything im going to make a substancial loss.

oh and btw I emailed 3 valve addresses, one for SDK questions, one for engine liscencing and one for general enquiries, as of yet no replies but I got recipts so I know my emails are there.

If you buy bulk, running 100 copies, it'll actually only cost you about 35.7 pence per DVD.

£17 19ml printer cart @ 450 printed sheets of paper* = 3.7p per sheet
£15 100 Cd-r 52x = 15p per cd
£7 100 blank DVD cases =7p
£10 100 sheets HP glossy photo paper = 10p

*you'd invariably use the other 350 colour pages some other time.

This whole situation puts me in mind of Anime fansubbing as it was before the internet really took off with video filesharing. Fans in Japan or Asia with translation skills would record or duplicate broadcasts and VCRs of anime shows, and sell them to people around the world with subtitles. The anime industry tolerated this action on the condition that: 1) the fansubbers charged only for materials and shipping. 2) the media contained a request for the consumers to destroy their fansubbed material and buy legitimate VCRs when available in their territory 3) the fansubbers must cease distribution of a series once it was licensed for sale in countries where the subtitled language was spoken. It was never really a legal practice, just one that the companies tolerated because there was the benefit of getting the word out of Japan and generating interest among fans who would then in turn get international video licensers interested.

Now the situation here isn't quite the same, and I don't believe the benefits for Valve are nearly half as large. Nontheless, I don't think Valve would be too bothered if you were to distribute a mod for materials cost only. After all, it's entirely functionless without the recepient owning a Valve product, so in a best case scenario it could be the cause of revenue for Valve. It also depends on the scale of your operation. If you distribute thousands upon thousands of discs, Valve may start to care. If you're distributing a hundred or so to people who really need them (those that can't download because of slow connection speed for instance), Valve probably won't care too much provided you're making an effort to not make profit.
 
Or how about this:
You burn your mod onto tons of Cd's
Then this part is free, but then there is also a case that you sell completley seperate for $2.00 that goes along with it.


But yeah just distributute it over the net or get it on a USB drive and just go over to there house stick it in copy the files and there ya go.
