Microsoft's army of lawyers was no match for a kid from Kent State.

I suppose you might say that they do have a dictatorship, and they are evil, and all that jazz, but we have to admit, most of us use Windows, and its subsequent programs. It isn't all bad.

Yet if you were accused of a crime you didn't commit or get sued for something that you believe in unjust, who would you turn to to help you?

Corporate lawyers can be lazy when they are filing thousands of cases a year. Cases that are really just fairytales.

Lawyers are pretty much crooks anyway. $140 an hour doing stuff that quite frankly you can do yourself. Yeah, if you murdered someone of course you'd want a lawyer. But in smaller cases that don't require court you can probably do a lot of it yourself without lawyers ripping you off.

My mum had to deal with a lawyer for a few months spending loads of money, and at the end of it all she was left thinking "why didn't I just do it myself?"
 
He did do a great job. And I would have told Microsoft if I was there lawyer, forget it, what the hell are you doing. It may be that Microsoft has told its lawyers, sue every single person that sells software on ebay/ But in Australia at least, there is section 198J of the Legal Profession Act - which says that a suit must have a 'reasonable prospect of success' Microsoft's suit had no prospects of success.

In California, there is no similar thing to 198J (not that I know of)- only that pleadings are in good faith and so on - ie not ridiculous claims. Although pleadings can be struck out and you can get sanctions against you, and the judges may say, 'I hope you brought your checkbook with you Mr X, you may need it after we have finished with this complaints'.

I have heard this and other stupid things that Microsoft does. A friend of mine is a self-taught IT guru, from way back when - and was volunteering for a progam called 'PCs for Kids'. The machines were old boxes with Windows 95 on them, and they were fixed up, checked, and maybe a crappy modem was thrown in on the deal - and the computers sometimes with old printers, were given to disadvantaged children in housing commission buildings (projects as they call them in the USA or Estates in Britain).

Anyway, Microsoft decided that giving away Windows 95 to underprivileged kids was a huge threat to its corporation and sent lawyers after PCs For Kids. After a massive PR backlash, I believe Microsoft slunk away again.....

But I remember the American accented valley girl spokesperson from Microsoft repeating over and over again 'Microstoft does not support people violating its copyright.' No matter what question was asked of her.

Sometimes - you need the lawyer to say to the client (and I always do) this is just dumb. But to be fair to the lawyers, maybe they did, and Microsoft said sue em anyway. I've had that happen too.

$140 an hour? Are you kidding. My charge out rate was US365 an hour, and I was a Senior Associate not a Partner. The partner charged at US600 or so.

But your other comment is complete load of nonsense. If people could represent themselves, they would. Especially banks and large corporations.

Very few people have the skill or training to represent themselves. They normally just ending making fools of themselves. Its not as easy as you might think. I did 3 years of law school, I passed the California Bar exam. I worked in Australia, Hong Kong, and the United States of America for some of the largest law firms in the world since when I finished law school in 1997. There is no way in *hell* you would be able to do what I can do.

If you came up against me in what I do, which is Industrial law, I would guarantee I would wipe the floor with you. Despite you believing that you can do it all yourself.

This guy had a good case - the law was on his side. Most cases are not so open and shut. And as a student he had the time on his hands.

You could say that of any profession. Why go to a mechanic- let's fix the car yourself. Or lay your own carpets. Or why not do brain surgery on your relatives in the backyard? The medical textbooks are in the library, just purchase Brain Surgery for Dummies.....

The reason you do is because - they know what they are doing, and you do not.

Why do banks, large corporations hire lawyers to represent? Because the lawyers were worth it.

And if you still say - oh I know how to do it its easy - I could set you a little assignment and lets see how you go?
 
Yay. What a bright kid. I'd do the same as him myself, there's no way with a proper justice system that a corporation would get away with that aslong as you put up some form of defence for yourself.

Bring it. As I say - I'd wipe the floor with you. If all you needed was a degree in Google-O-Logy - there would be a lot less lawyers. Its not as easy as you think.

Yay!!! He defeated the evil microsoft! yay!!! yay!!! hahah ya!! I knew he could do it! Microsoft isn't that bad of a company, I don't understand why everyone orgasms over a microsoft screw up/failure or any other thing.
