NSA Wiretapping = Stopped; Deemed Unconstitutional.

A federal judge ruled Thursday that the government's warrantless wiretapping program is unconstitutional and ordered an immediate halt to it.

U.S. District Judge Anna Diggs Taylor in Detroit became the first judge to strike down the National Security Agency's program, which she says violates the rights to free speech and privacy.

Anyone surprised? I am not that surprised, but I am quite relieved. These guys need to be reined in every once in a while. Good to see courts with some sense ruling justly (as they did with the videogame settlement the other day).

The real question is if this'll actually make the administration do less 1984 shit.

This ruling was nothing more than common sense. The problem is they will continue to appeal this so it wont be stopped for a long while.

That's certainly how they will spin this as both the judges that ruled this was unconsitutional (the other one was in San Francisco) have been appointed by Democrats.
 
Well, it is unconstitutional. The Bush administration sought to ignore that. The courts are the only ones who have any sense nowadays.

I can already see how the Republicans are going to spin this one.

Hey! You'd think it would be common sense, but these days, who knows?! Its a thread to let people know that not all of our rights are being flushed down the toilet. Its a victory in a very uphill battle, but one that finally seems to be swinging the other way.

Warrantless wiretaps = unconstitutional. There is no debate on that issue.

The Department of Justice made a statement the same day that it firmly disagreed with this ruling and supported the President's surveillance program. Emphasis mine:

The Terrorist Surveillance Program is a critical tool that ensures we have in place an early warning system to detect and prevent a terrorist attack. In the ongoing conflict with al-Qaeda and its allies, the President has the primary duty under the Constitution to protect the American people. The Constitution gives the President the full authority necessary to carry out that solemn duty, and we believe the program is lawful and protects civil liberties. Because the Terrorist Surveillance Program is an essential tool for the intelligence community in the War on Terror, the Department of Justice has appealed the District Court's order.

Where in the Constitution is the President granted this all-encompassing power to do whatever the hell he wants? Does the Department of Justice not know its own laws?

That's awesome. Using that anti-logic, he should throw everyone into gulags so that nothing bad can happen under the watch of the machinegun-toting guards.
