A 20-year-old college student was indicted Tuesday by a federal grand jury in Tennessee for allegedly hacking into the Yahoo e-mail account of Republican vice presidential candidate and Alaska governor Sarah Palin.

David C. Kernell, a student at the University of Tennessee and the son of Tennessee state Rep. Mike Kernell, a Democrat, turned himself in to authorities on Tuesday and will be arraigned Wednesday before Judge C. Clifford Shirley.

If convicted, Kernell faces up to five years in prison, a $250,000 fine, and three years of supervised release. He is accused of gaining unlawful access to stored communications and obtaining information from a protected computer via interstate communication.

I hope he gets a good lawyer. The guy is an idiot and a douchebag but I can't help feeling sorry for him. All he did was reset her password because she was stupid enough to use yahoo for her emails (something that was illegal for her to do in the first place). And if the max he can get is 5 years then he should be sleeping easier, this could have been a lot worse.

well he will have a criminal record if convicted and will have a hard time shaking this because of the media frenzy around the story ..he's lucky if anyone hires him.
 
I'd be more worried about the 5 years in prison than what my career opporunities will be afterwards. But I was expecting the max time for something like this to be up to 20 years in prison. If it's only 5 a good lawyer could probably knock that down quite a bit. And I don't know that they will want to make an example of him, based on what we have seen since this "hack" first happened the McCain campaign has been trying to keep this as quiet as possible. Again, by using yahoo for official business she was breaking the law, they don't really want americans talking about that.
 
he probably wont see much jail time; time served and perhaps 30 days or so on top ....his record will follow him around for life

you do somthing wrong you should be willing to face the consequences. The consequences for his actions is a fine and 5 years the thats fine by me ,yes he was a stupid kid but stupidity should not be a valid excuse for what he did, he obviusly knew what he was doing was illegal but he still went ahead and did it.

She went into politics, voluntarily exposing herself to whatever people might think of her, and they thought she was terrible.

Five years seems a bit much for guessing/resetting a stupid yahoo password and I bet if it was Joe Public's account the FBI wouldn't give a shit.

But while the hypocrisy of it bugs me, I wouldn't want someone rooting through my life and shit, I think what he did falls under the umbrella of identity theft and that is a pretty serious and damaging crime so basically he deserves punishment.
 
Fucking ridiculous. Yeah, what he did was wrong, but there's no reason to put this kid in in jail for 5 years and fine him to death. Would this have happened to him if he guessed his friend's password and his friend found out about it and pressed charges? Hell no, they'd throw that case out faster than his friend could state it. Since the account belonged to some dumb bitch who happens to be governor of Alaska/vice presidential candidate, this kid's life gets trashed.

Nevermind the fact that Palin was using the account for state matters which is completely illegal. Let's focus on ruining some 20-year-old college student's life.

It was a stupid thing to do, but this is utterly draconian punishment.

5 years is way to big for 'resetting password' of an idiot.

And you know this wouldn't have been followed up if the yahoo account had been anybody who wasn't famous.

Also, didn't he take screenshots of the emails and upload them on the internet? that makes him even more stupid. don't know about 5 years though, sounds kinda harsh but oh well it's his own fault for being stupid. I always have a hard time feeling any sympathy for hackers. Or "hackers", whatever.

it could be on advice from his lawyers ..this is s preliminary hearing, he'll probably change it to guilty when it ever goes to trial ..it's a jury trial so they'll probably give him a slap on the wrist
 
I acknowledge that the punishment is a bit over the top, but I'm simply not able to feel bad for the dude even if I tried.

Section 17, Article 1 of the Information and Communication Secrecy Protection Law

Those who violate the above rules stated above in Section 3 (Any persons, without consent, censors, blocks, wiretaps, or listens/reads/views electronic communication material) will be imprisoned for up to 3 years, and/or 10 years probation for officials (if in accordance with the Social Security Law), and/or a fine of up to 30 million won (30K USD). Exceptions are treason, sedition, regarding international relations, mutiny, aiding the enemy, or otherwise listed in the National Security law or the Military Secrets law.

So our supposedly draconian laws are actually a helluva lot lenient than those of the US. Hah! I win!



Anyway, I believe that our communications and secrets should be protected to the fullest, under applicable laws.

Except that a mountain climber in all honety has acheived a thousand times greater deeds than someone who guesses a password. Besides, mountain climbing isn't illegal, and you can't really push the limits of the human body and sprit by guessing a password. (Of course, if this guessing took a decade or two, I;d be impressed.)
