A man who uploaded Super Mario Bros. for the Wii before its commercial release has agreed to settle with Nintendo. The 24 year-old, who uploaded the game to the Internet in November 2009, has agreed to pay the games giant $1.3m in damages.

James Burt, a 24 year-old manager at games retailer Electronics Boutique, admitted uploading the game on November 6th, a week before its commercial release in Australia.
The game was a sure fire hit on BitTorrent. Data collected by TorrentFreak indicated that by December 27th 2009, the game had been downloaded 1,150,000 times.

I hate that people leak media before it even comes out. That's ****ed up. It might be alright if it was for a handful of friends, but over a million people downloaded it, according to TorrentFreak. Curiously, this game actually released first in Australia.

Works out to be about $1 per download. He got lucky, I think it could have been much worse. For example, record labels would have tried to get full retail value for each download.

While I agree with the legality of the issue, I really wish courts (and companies) would agree on settlements/fines that are within the perpetrator's means of paying back. The guy's life is pretty much completely ****ed now, with almost everything he makes his entire life going to Nintendo. I wonder if he will just declare bankruptcy and get out of paying it back.

I agree with you here, its horrid to say that one mistake will cost this man his life - small crimes give small prison sentences but for one mistake it will cost James Burt the rest of his life...

Yep. I even had a game pre-ordered at EB once (once) and they called me up the day before release like "hurf we're giving them out early lol come get it."

Merely pointing out that Nintendo don't *need* that much money, fair punishment or not. They're well within their rights (maybe), I'm just saying it's kind of excessive in light of their huge success, with this very game no less.
