Could I be sued?

Some girl used to go to my school a while ago before moving back to the United States. One day, somebody came across a bunch of photos of her and another girl in erotic poses and shit. No nudity, but it didn't paint them in the best light.

Any way, me and my friends posted it up on our own forum and we all had a good time. It hasn't left the forum, at least to my knowledge. Eventually, some of her friends told her and she got all pissy about it. My brother, being the cuddle bitch he is, was pretty much her contact about this for the entire time, but I didn't care. He wasn't going to ****ing do anything. She bitched, moaned, told us to take it off, but we didn't. I guess that's what you achieve when you make angry threats through people that aren't ****ing affiliated with the forum.

Now, a few months later, my bro finally shows me this.

"you need to get all those pics off of the internet NOW. i dont care how much ur brom bitches about it. ppl from my school are seeing them. i dont know how they know the web site. but guys keeps coming up ot me. this isnt funny anymore not that it ever was. but u need to tell chris to stop being an asshole and realize wat hes doing. cos my parents already know, and they want to sue him and the rest of his stupid freinds and theyr gona do it if they arent off by the end of the week. dead serious."

First of all, I'm going to call bullshit. You are not going to find the forum on some ****ing google search. None of the people at this school know anybody at her school. The pics haven't been spread about. I'd say she's making shit up.

But that's not really the issue. Suppose it is true? Is it possible for her to take legal action against us? I doubt she even would if she could, but I'm still curious. We're running off Swiss servers, so I don't think the US has jurisdiction over this. I'm not particularly worried. If this turns out to be for real, the pics will be removed with no skin off my back. But I'd just like to know if she'd actually have a case.

Of course, I'm not doing shit until we personally get direct correspondence with her.

I just copy & pasted that from another forum. As an update, I'm informing you that I have since spoken with her on the phone. She somehow thought it was my fault and I told her that I neither took, hosted, or posted the pictures and that the forum is not mine. I've forwarded her to more relevant people for that.
 
I would say remove them. why have them on the website?

damaging someones image or some legal jargon.
maybe they would call displaying pictures without consent.. idk

I know that in some cases you need to fuzz out their faces if you use peoples pic in video& photos without their consent

It depends on if she's being harassed as a result, but I'd say she wouldnt win if the pics were taken while she was in the public- they're depictions of events that occured in the public domain and as thus, she has no right of control over them- if she owned the photos physically however, thats another story.
 
Despite what george bush may tell every one, your right the US has no jurisdiction over this.

And no, she's not being harassed to according to my knowledge. If she was, then I'd certainly take them down. But in our conversation over the phone, I asked her how she knew other people had seen them. She really didn't seem sure of herself and came off as making up vague and fake scenarios on the spot.
Nobody that's seen the pics has harassed her either. No e-mails, no phone calls, no nothing. This has all been contained in one location, and it's buried in a topic that's been dead for months.

Yeah, why don't you just get them off...she is begging you and yes you can be sued. Two years ago two girls in my class made this website where they put three pictures of teachers and they also made some stories with them. They both got kicked out of the school and they have been sued. I think they won though.
 
I'll probably ask them to be taken down (for the time being) tomorrow. Better safe than sorry.

okay, u have made it clear that u can't take them down since ur not in control but lets just assume u are for a second... just take them down.
in life strange things happen and im sure the last thing u or anyone else involved in this mess is legal action regardless of how funny or deserving it was.

if i were u, i'd get in touch with pple who do have control over those pics and have them removed...im sure theres other ways to do funny things which don't result in legal action or hurting others.

If the two girls in your class did indeed win the case, surely that indicates that you cannot be sued for this?

You should have blurred out her face first, be very careful about uploading peoples pictures on the internet if you can identify them. You could ask the admin to remove them.
 
I doubt you'd get sued for it (although, even if it's not US Soil, the countries still have friendly legal ties with each other and work together with court stuff internationally)

But you sound like you deserve it. Not a personal attack on you but that really just was an assholish thing to do.

Well, I heard they could have received an amount of 10,000$ to pay to the teachers. They won though because what they wrote wasn't that bad. But YES, you can be sue for this. It depends on how important is the intimidation.

She could probably get you to remove them. But your main concern is how old they were when the photo's were taken, if they were under 18 at the time, you could be in real trouble, they don't have to be naked, the fact their "erotic" could be enough to cause trouble.. All they'd need is a good lawyer and be under 18 at the time of the photo's and then the shit could really hit the fan for you having simply been involved, and the place their hosted and anyone else connected with it.

I'd remove them if I were you, just to be on the safe side.


Edit: ok just realised your in Switzerland.. I dunno what the age limits are for things like that. You could still get your ass handed to you on a plate though. Take em down, its kinda weird you want to keep them anyway..
 
take the damn pictures down man. You are harrassing her by even posting them in the first place. and she asks you to take them down and you dont? what kind of evil person are you? you are using her humiliation for your own personal desires. Give the girl a break. She can sue you, and sounds like she has a strong defamation case. remove the pics

Gets worse.. somehow those images would get out.. If they started, or already were doing the rounds in certain circles of people. Then things could turn very nasty for anyone involved in it. Would suck if they were put on registers for life because of a little mistake like this that got out of hand because they wouldn't remove them.

Anyone could have viewed them, kept them, given them to friends, put them on other forums or newsgroups, P2P, IRC.....


And yeah, I'd be shitting bricks right now if I were him lol
 
Anyone remember "Star Wars Boy" I heard he ended up sueing some people for that video, dunno if he won or not, but he probably did. So I mean its better to take the photos down, wait till she is 18, if there is dates on them, remove them, and just put them back up ;)

Her initial "requests" to take them off were "omfg fk u asholes TAKE THEM OFF OR ELSE fscks". And as I've said, she was a lot more reasonable over the phone.

I'm going to request that the pics be taken down tomorrow.

Well, honestly, I would never ever upload erotic pictures of anyone I knew on a public forum without their consent, even if I hated their guts. I'd say just take them down for moral reasons.
 
What kinda forum was this? also she probably just heard about them once and didnt even see them but i bet she knows what it was about anyways why the f*ck does she care if some forum people in the UK or Us see here pics??

If she said you could put them up and then changed her mind thats a different story, but she didn't.

Before you go any further, your basically condoning posting what the law would see as pornographic imagery of underage children. Don't for a second think that just cause there's no proof of age, it wouldn't matter.. Porn sites or any imagery of so called teen girls, barely legal etc. etc. etc. have to be able to provide proof of age if asked, aswell as abide by the laws of that country or they get shut down and investigated, if they can't provide proof then well, gotta ask the question Why? If someone goes to lengths to disquise someone in a photo and its already being asked to come down, and the girl in question was underage. It's going to be next to impossible to "get away with it".. Frankly I don't even understand why your suggesting this.
 
It was pretty low to put her pics on the web in the first place. I'm sure you wouldn't like it if you had your pics posted everywhere without your consent. And you can't really say the pics weren't circulated. I bet you all the teens on that site you posted it on, the horny boys, passed it on to their friends ad nauseam trying to pass her off as their girlfriend.

But. You probably couldn't get charged with anything, unless your country has laws against that sort of thing.

I'v been in a similar postion with one of my friends, putting a photo up on a site without permission and he got all arsey with me. So i did take it down, and in future asked permission. He would have let me anyway, its just common decency to ask really. I learned my lesson.
