Actually, as long as the pictures themselfs don't show the person/people in bad light, or in postures that make them look degraded, the person who took the photos own all rights to them, the people on the photos have no say in what they are used for, unless they somehow insult/harm the people/persons on the photo.

Doesn't it depend on if the girls consented to their pictures taken, or is that what you ment?

And what exactly have I done? The only connection I have to this is that I happen to post on the forum on which the pics are located. I have no reason to believe that she can't tough me, nor the members involved. And if she can, whoop-dee-doo. Pics removed. Whatever. But I'm not going to back down on this if the pictures are legally allowed to stay up, especially when she has essentially challenged us to a duel.

And you say the age of consent is 16, but the problem is, she didn't give her consent?

Age of consent as in "You're allowed to bang her". That was in reference to your idea that this could be pedophilia.

So far, none of the people responsible have recieved any request or complaint from her. If she has a problem with them being online, then she should take it up with the person hosting them, because I can tell you right now that none of my friends stuck them on the net.

That adds a subjective element to this. I would even go far as to retract my statement about them being "erotic". The one pic we have up is one of both people laying on a bed in shorts while flipping the bird at the camera. Construe that however you want.

And besides, she couldn't ever sue you. If you're not the one who posted the pictures, and your not the server owner/site owner or a forum moderator who can delete the posts she can't sue you.

Describe exactly what the pictures show, you say there is more then one? Even if the pictures don't show her in the nude or doing anything embarressing, she is still in the right to ask for them to be taken down. She has asked you to take them down, so the gentlemanly thing to do would be to talk to the admins of the forum, pass the message on that she would like the pictures taken down, and send a reply back apologising for your actions.

I can't remove the pics on that forum for the same reason I can't remove them on this forum: I don't have any admin status.

There are people that could remove them, but they aren't willing to. They doubt she could win in a court case, let alone sue.

So it isn't you being the arsehole, it is the admins of the forum being arseholes? Prove to everyone here that you're not an arsehole by supporting her case to have the pictures taken down, be a gentleman.

Wether or not that thing flies in the United States is irrelevant.

And as one who has not even seen the pictures, I'm not sure how you can deem them "disgusting".

But you said it's "your" forum... How is it your forum and you have no admin rights? You have no admin rights on this forum because it isn't yours. If that one is, then you can take them down.

There is more than one, but they only exist on the hosted account (which, I repeat, is not ours). Only one photo made its way onto our forum.

It's humoros only because they're attempting to be hot.

Jesus, do we need this banal drivel over semantics? I consider it "my" forum because it's something that I am a part of, just as I would say that the CS-OTF is "my" forum because I have had a long run there and daily take part in it. It was not intended as a pronoun signifying ownership.

"Erotic" was just the first word that popped into my head. And judging from what people think was implicated by that word, it was probably a poor choice of diction.
 
If it's not your site, why is she bothering you? Did you actually post the pictures? Surely you can't just edit the topic and delete the links if you did, or get an admin to. If the admins won't for whatever reason, then I don't see how you get sued or get into any sort of trouble over it, (that's if you didn't post them in the first place)

My only relationship with those photos is that I commented on them.

Why is she bothering me? Good question. I certainly can't get into trouble for this. But I have not seen compelling evidence that suggests that even the poster or the forum admin can get into trouble either.

If she has an issue, she should take it up with the person that hosted the pics. But this has apparently not crossed her mind yet. She looked at the forum, saw the picture, and assumed that we were the sole culprits.

I was more curious as to wether or not she had the ability to demand us to remove the pics from our forum.

I never felt she had a case against us, but I wanted to be sure.
 
I guess it doesn't bother you that it is an online site Absinthe, and that those pictures, almost without a doubt, will start circulating like wildfire across the internet, likely to locales for which the legal age is 18, so in effect becoming underage content for perverts who like that sort of thing.

It's an online forum. It's going to be circulated, no doubt and you can't put in a convincing argument to deny it, especially since the site owners are immature assholes from the sounds of it.

Although I do agree that nothing is 100% secure on the internet, please point me out to the rule that states "anything online will get around to everybody". And do I have to state again that there's nothing pornographic about it?

The law is the law.

It's an online forum. It's going to be circulated, no doubt and you can't put in a convincing argument to deny it, especially since the site owners are immature assholes from the sounds of it.

You know, I really couldn't care about what some of you people deem moral or mature on this matter. My question was wether or not it was possible for her to sue. And from the sound of it, she can't.

Actually, from a little online study, it does indeed look like Switzerland has Libel laws, which could apply in this situation depending on what you guys wrote on the website about the pictures.

Also... it looks like Switzerland, just like the united states, Australia, Canada, Germany, Austria, and France... has defamation laws as well from what I'm reading. You know lawyers... They can make anything out of nothing if their client wants them to.

I dunno man. If I were you, I would take the high road on this and be on her side. Try to convince them to remove the pictures. Or if you want to keep being stubborn about it, go ahead and do that too. Just don't post a topic for sympathy if she can indeed form a case about this.

Libel is an entirely different bag of beans, and we've written nothing that constitutes it.

Oh no, there most certainly wouldn't be a topic of sympathy. It's been shown on numerous occasions that not too many people here are fond of me and my views, and such a thing would just invite more piss and vinegar.

No, I CAN'T remove it. But I don't think I'd really want to any way.

I think I've already stated that I'm not too worried about this, as I doubt a case will even materialize. And from my knowledge of Swiss law, I didn't think she'd be in a position to sue us. This topic was mainly for clarification purposes if I had been incorrect. And so far, that has not happened. So thank you for helping me reach the conclusion that nothing will happen. And if you have such an issue with looking up Swiss law, then I cordially invite you to refrain from doing so.

I'm probably not very convincing when I say something without my heart behind it.
