As has already been cleared up, its nothing to do with money its to do with who owns what.
 
outlive, as much as i love ya'lls work, i would definitly think about it, and contact square. f they owned mana, and they already shut down a mod, then i would definitly fear that.
the deal with these companies is, its their reputation. If they think your making a crappy project, then they don't want that crap associated with their product, then they will shut you down, cause they don't want that associated with their product.
if they think your making an excellent productthey might not mind, and with the quality thuus far, i would definitly approach them about usin the license.
I am assuming your the leader, and if you get shut down, your personally responsible for wasting your team members time.
the thing about ffair use is interpertable. i remember in college, when discussing our demo reel, we talked about using pro musicians in our works.
If its a school or educational project, thats fine, but as soon as you put that music on your on yur demo reel, then you need permission in order to use it, because its considered self promotion.
thats the key that you need to understand. they can shut you down, cause you have people who relate their personal name to the property of the company, and it can be seen as self promotion, which doesn't fall under fair use. if you have any ads to pay for your site, or for site hosting, wetherr you think it or not, your making money off of their work. if you get free hosting for the ad, your still making money off of the work.
people have pointed out examples, and one by the publisher that made the game your recreating, i wouldn't take that lightly. the law is very interpertable, but there are examples upon examples of sites getting shut down because of this.
If i were ya'll, i would sooooooooooo try to get permission before continuing the project, if not, i would change it up a bit like bid for power did, in order to comply with copyright law, or else ya'll are gonna get some serious smacking by lawyers.
at least talk to a copyright attourney. i would hate to see this mod make so much progress then get shut down. it looks too damn sweet to not get released.

what you mean finally? there was a BUMPERCARS mod for hl1, that was ****ing sweet. and a SOCCOR mod.

and lots of other non-fps type mods. where you been man?
