A fundamentalist church that protests at soldiers' funerals faces its first lawsuit today from the family of a fallen serviceman.

Members of the Westboro Baptist Church face trial in Baltimore for an invasion-of-privacy lawsuit filed by the father of a fallen Marine from Westminster. Albert Snyder of York, Pa., says the church interrupted his grieving process at the funeral for his son, Lance Cpl. Matthew Snyder, who was killed in Iraq last year. Church members say they were only exercising their free speech rights.

The lawsuit is the first in the nation to be filed against the church by a grieving relative. The church believes war deaths are God's retribution for America's tolerance of homosexuality, and their protests have inspired almost two dozen states to put new limits on protests at funerals.

Last week, a judge threw out defamation claims against the church, but Snyder's lawsuit is proceeding on invasion-of-privacy grounds. He also seeks damages for intentional infliction of emotional distress.

Hurray!

I can't see it happening, but I hope they get hit hard.

as loathsome as they are invasion of privacy is a bit of a stretch ..they were off church grounds ..unless they're going to argue that the church's property covers all land

No no no no no... noooooo no no NO!

You can't go and justify the protection of this church, this horrific westboro baptist church!

Even if it means standing in defiance against all laws that might somehow protect them, you must be supportive of them being screwed!

It's the principles, man!

yes I understand but the law is supposed to be equal for ALL ..regardless if they're a bunch of ****ing crazies

It shall be forever known that this day, Thursday, October 25th, Cpt Stern stood up on an internet forum and defended the Westboro Baptist Church.

what time zone are YOU in?

bizarro world ..I'm there too cuz apparently I agree with the God Hates fags people

"I disapprove of what you say, but I will defend to the death your right to say it."

Even though the WBC is full of inbred assholes, our constitution protects them, which is the way it should be. Freedom of speech is our most important right as a society, and if we lose that, we will truly be living in a police state. Censorship is bad enough. All we can really do is hope that one day they'll slip up and get nailed for it.

Or exploded.

And then everybody can say god hates them.

Finally, these people are idiots. However, they are speaking the truth when they say the christian god hates fags:

"If a man also lie with mankind, as he lieth with a woman, both of them have committed an abomination: they shall surely be PUT TO DEATH; their blood shall be upon them." Lev. 20:13

It's true. Krynn is officially living in the past!

Then the bible contradicted itself when it says God loves everybody.

Butt his isn't the point to be discussed here. It's to hope that the church gets what it deserves.

if you read the FAQ, theres a question like "how do you know god exists?"

they quote scripture as an answer...hahahaha, morons

Holy shit?! There is an actual law system and a god? BooYA!

Yay.
Soldiers die for our freedom.
Bitches.

The cost of free speech, I guess.

What do you do against people like that? My first thought was using free speech against them by basically harrasing them wherever it was legal, to give them a taste of their medicine. But if they're thick skulled enough to demonstrate their beliefs at someone else's funeral, they'd probably just see it as a test of their ****ing faith or something.

If God is real, then his followers are surely some of his sickest subjects...

Don't see it happening, even though I secretly want it to.

As obnoxious and stupid as they may be, their protests are legally in the clear. Free speech is never gonna be all rosy, but what can you do?

inciting hatred is a bit of a legal grey area in the US

wikipedia said:
In the United States, government is broadly forbidden by the First Amendment of the Constitution from restricting speech. Jurists generally understand this to mean that the government cannot regulate the content of speech, but that it can address the harmful effects of speech through laws such as those against defamation or incitement to riot.

Various institutions in the United States and Europe began developing codes to limit or punish hate speech in the 1990s, on the grounds that such speech amounts to discrimination. Thus, such codes prohibit words or phrases deemed to express, either deliberately or unknowingly, hatred or contempt towards a group of people, based on areas such as their ethnic, cultural, religious or sexual identity, or with reference to physical health or mental health.

It's not free speech when inciting hatred.

Bad language can also incite hatred. Or a person condemning Islam. I'm sure some people are hateful when a minority speaks about equality.

Westboro voices an opinion. A sick and twisted one, but still an opinion. And since they are not directly provoking violence, they fall under the same protection that's offered to people who make anti-Bush signs at a protest rally. This is also the same reason why NAMBLA got off with its trial.

This is an ugly reality that inevitably comes with free speech.

Well I don't personally see it that way, in my mind any half decent lawyer can convince a jury that holding a sign that says "thank god for IEDs" is the same as holding one that says "blacks are animals." I'm positive that the plaintiff will win the case, there's no chance in hell a jury will side with Westboro on this, not unless they pick members of the church for jury duty.

but they could just as easily say the "god hates fags" targets a specific group ..but they dont because unless they're working for an institution free speech protects them from prosecution ...the same will apply in this case ..now had they been on the cemetary grounds they could be cited for trespassing but breach of privacy is a bit of stretch

look I dont like defending these idiots but I think the case will most likely get thrown out of free speech grounds

in canada it would be a whole different matter ...inciting hatred IS against the law and they would be charged with a hate crime and arrested

'The church believes war deaths are God's retribution for America's tolerance of homosexuality'

You couldn't make this stuff up.

Batshit insane :rolling:

I know, I understand what you mean. I mean if the jury were us, they'd be charged guilty on all accounts.

And I reread the article, didn't notice that last part: "Last week, a judge threw out defamation claims against the church." ERFFF... guess it's not going to be the easy victory for the plaintiff I had imagine :(

if I were the jury I'd shoot them dead without a hearing ..actually I'd just shoot them on sight

"and the lord said ..."<BANG ...bangbangbang>

..well that's one down. who's next

"but .."<bangbangbangbang>

"Jesu..<bangbangbangbangbangbang>

I endorse this action and/or product.

Presuming "the existence of the Christian god" (terms an atheist should understand), then these people are already condemned to the fires of hell, and it will be a day of celebration in heaven when these people die.

It's one thing to say "god hates fags" which is supportable in the Bible, however it's their other actions that are disturbing.

The kid who put Korans on the toilet was almost charged with a hate crime. Im sure there are some clever ways to put these people in prison. You could say they are targeting non-believers as a group.

Heh. They even target believers.

The only people they think AREN'T worthy of their criticism is their own family.

I bet they are so disturbed that even when one of their family members die, they'll label them as fags who deserved to die.

I've always wondered that. What happens when some crazy guy comes up and shoots one of the family in the face? Did they deserve to die? Crazy bastards...

these people had a protest outside of a middle school in my town because the school has a rainbow flag. I forgot about that incident. I wanted to drive by and repeatedly yell the c word.

Don't forget to throw a soda at the children's head.
