Things are made illegal because they're bad for society as a whole
Porn, as a whole, is not bad for society.
Prostitution, as a whole, is bad for society.

Hence the distinction, at least in my opinion.

Sure they're morally equivalent, but that has nothing to do with law. The law looks at not only the action but the effect of that action.
Illegal things are not always illegal because they are legitimately bad, and often the reverse is also true.

Marijuana is illegal (at least in the US), despite having very few negative consequences of minimal severity. Alcohol, on the other hand, is completely legal, yet is many times more harmful, and can easily be fatal.

The first thing you have to realize here is that the law is not infallible. Its marginally fluid nature means that it can be exploited and changed in ways that are not always conducive to the positive progression and development of society.

So in that sense, prostitution is not necessarily bad. I suggest you look at it from a philosophical standpoint, rather than a purely legal one: What purpose does it serve? Who is involved? What are its consequences? How does it affect those who do not take part?

Oh, the law sucks. Especially when it comes to drugs. I'm even all for legalizing prostitution. I was just saying the law tries to strive for the good of society and porn doesn't harm society whereas prostitution in it's most common form propagates slums, the spread of diseases and therefore an increased burden on the state medical bill, along with more unhealthy citizens.

I realize from a moral or even libertarian stance that it's simply the people involved in the action that are being harmed, and since they are adults it's their right to harm themselves all they want. However, we don't live in a libertarian society so that doesn't really apply. (Or at least I don't :P)

It does all of these things because its illegal. Why would you expect them to stay clean, get tested and all that if its all illegal? The Bunny ranch in Nevada (or somewhere around there) is a legal brothel and the women all have to meet stringent laws.

Same goes for marijuana. The fact that its illegal is what fuels all the bad associated with the drug.

When it was legal, there weren't any regulations, and that created problems. So it was made illegal. Of course it could be legalized and properly regulated but the government tends to have better things to do than worry about people being able to legally screw strangers. Like i said, I'm all for legalizing it, I was simply explaining why it is illegal, not why it should be. So I'm not really sure why you're arguing why it should be when i agree with you

Legalization goes almost hand-in-hand with regulation, and when something is regulated, the quality and safety of the product almost invariably goes up. Regulated prostitution would be just as safe as, if not safer than, everyday sex.

[edit] And we can already have sex with strangers, we're just not allowed to pay for it :E

So by making it illegal, they are now able to implement regulations? Does the government have financial/legal ties to a druglord who ensures the crack dealer on your street verifies customer ages and ensures quality control?

Legalizing it would ensure that dangerous distribution is minimal and that a minimum standard of quality would be met (whereas the black market needs no such thing).
 
on Drugs and Marijuana: The best thing to do would be to educate the people on drug use and legalize it. Prohibition doesn't work and regulations might cause a stir.

PORNSTARS: No!One is not paying the other for sex. Both parties are being paid by a 3rd party. They may enjoy their job, but they aren't having sex for just pleasure. Plus, porn is great!

By these two definitions, wouldn't a large portion of the female population be considered a prostitute? Hell at least with a prostitute or pornstar you know what to expect.

No. They're starring in a film where sex is the main act. A prostitute is paid directly for the sex by a john. Also in porn the man is paid for his part in the film too, he doesn't pay the woman anything and therefor is not a john.

I meant the government would be able to tax a prostitute's income. How could you pay tax to a prostitute, that doesn't even make sense unless the government is full of hookers.

If brothels were ran and regulated by the state, then yeah, taxes would go to prostitutes. If brothels were privately owned but had to adhere by a code of standards set by the government, you would be happy. (well, you're happy without legalizing prostitution, but you know what I mean.)

It's not a government-run thing so taxes aren't involved at all. If anything, the government will make money off of it and all they have to do is setup some regulations.

If you're paying both her and the other parties involved for their participation then it's not soliciting. However if you are planning on making films though, I doubt you'll find that many people who'd be prepared to have unprotected sex with a girl straight off the streets tbh. Despite the apparent casual nature of much porn (film, internet), it's an industry and everyones fully checked up for STDs etc.

In many of the movies I've seen they do wear condoms.
 
I think the figure was on wikipedia, but actually about 70% of the porn actors have some form of STD. Or did, before the checks.
 
The porn industry had a big AIDS scare recently, I remember hearing in the news that a Brazilian had contaminated all their booty!
